  • The Pilot Program began in May 2012 and ended in June 2013 [16 months]
  • With effect on 1st October 2013.
  • The change of name "Sistem Mata Demerit" (SMD) to SiKAP was announced on 10 September 2013.

 

Driver Safety Practice System (SiKAP)

  • A system where demerit points will be awarded to drivers who violated the highway and road traffic rules and regulations that may lead to the suspension or cancellation of driving licenses subject to the offences committed.
  • As a government effort to make "corrective measures" rather than penalizing drivers.
  • Encourage drivers to practice driving with more prudent and cautious whilst on the road.
  • SiKAP is introduced to ensure drivers in this country to drive in more disciplined, careful and complying with every traffic regulations.
  • Through SiKAP, enforcement agencies will be able to identify high risk drivers who often violated the road traffic regulations that may lead to accidents.
  • SiKAP will be able to improve and create a safer driving environment on the road for all road users.

 

SiKAP Categories

     

There are nine (9) categories of offences that carry demerit points starting with 3, 4, 6, 8, 9, 12, 18, 21 and 24 demerit points depending on the severity of the offences. Each category consists of offences mainly related to drivers attitude.

 

3 Demerit Points

  • Carrying a load on a vehicle in a dangerous manner OR load falling off from a vehicle that may endanger other road users
  • Vehicle left unattended with engine running and/or brakes not set causing possible movement of the vehicle and posing danger
  • Failing to switch on vehicle headlights between sunset and sunrise
  • Failing to keep left except when overtaking another vehicle or when turning to the right
  • Failing to give way to ambulance, fire brigade or police vehicle
  • Parking vehicles haphazardly, dangerously or illegally
  • Turning or stopping without proper signals.

 

4 Demerit Points

  • Stopping in a yellow box and obstructing traffic flow
  • Driving a vehicle without owner's consent.


6 Demerit Points

  • Driving a vehicle with bald tyres
  • Installing red lights at the FRONT of a motor vehicle
  • Installing white lights at the REAR of a vehicle other than reverse lights
  • Installing lights other than white headlights at the FRONT of a vehicle
  • Disobeying direction of traffic police
  • Driving without valid motor vehicle license (road tax)
  • Driving without valid driving license
  • Disobeying traffic signs or traffic lights.

 

8 Demerit Points

  • Exceeding the set speed limit of the road / for vehicle up to 30km/hour.

 

9 Demerit Points

  • Exceeding the set speed limit of the road / for vehicle by more than 30km/hour up to 40km/hour
  • Not wearing protective helmet or not wearing it correctly
  • Driver failing to wear a seatbelt
  • Driver failing to ensure that front seat passenger wears a seatbelt
  • Illegal racing or speed trials on roads or in public places
  • Using private vehicles for commercial purposes without valid license or permit
  • Driving a commercial or public transport vehicle exceeding the maximum number of passengers allowed.

 

12 Demerit Points

  • Failing to stop and give away to pedestrians at zebra crossing
  • Exceeding the set speed limit of the road / for vehicle by more than 40km/hour up to 50km/hour
  • Careless driving
  • Using mobile phone while driving.

 

18 Demerit Points

  • Exceeding the set speed limit of the road / for vehicle by more than 50km/hour up to 60km/hour
  • Driving under the influence of alcohol or drugs
  • Reckless or dangerous driving.

 

21 Demerit Points

  • Exceeding the set speed limit of the road / for vehicle by more than 60km/hour.


24 Demerit Points

  • Reckless driving causing death.

 

Targets of SiKAP

  Targeting all vehicle drivers:

  1. Probationary Drivers
  2. Qualified Drivers
  3. Foreign drivers driving in Brunei Darussalam

How does SiKAP work?

For a Probationary Driver, if accumulates 13 or more demerit points within a period of 12 months from the date of his/her license issued:

  1. His/her driving license will be revoked for a period of one year
  2. He/she will not be allowed to book or undergo a driving test during the revocation period
  3. He/she will have to re-sit both theory and practical driving test if he/she wishes to obtain a new driving license after serving the revocation period


    For a Qualified Driver, if accumulates 24 or more demerit points within a period of 24 months:
  1. His/her driving license will be suspended.
  2. Within the following 12 months after serving suspension periods, the driver's driving license will again be suspended if he/she accumulates 12 or more demerit points.
  3. During the suspension period, the driver has to surrender his/her driving license to the Land Transport Department.
  4. First and second suspensions will last for three (3) months and six (6) months respectively. The third suspension will lead to the revocation of the driver's driving license for a year.


if accumulates 24 or more demerit points within a period of 24 months:

  1. His/her driving license will be suspended.
  1. Within the following 12 months after serving suspension periods, the driver's driving license will again be suspended if he/she accumulates 12 or more demerit points.
  2. During the suspension period, the driver has to surrender his/her driving license to the Land Transport Department.
  3. First and second suspensions will last for three (3) months and six (6) months respectively. The third suspension will lead to the revocation of the driver's driving license for a year.
